Silk Road Institute for International and Comparative Law

The Silk Road Institute for International and Comparative Law (SRIICL), formally established as the Silk Road Institute for International Law in 2006 and renamed in 2008, is committed to the promotion of the rule of law and the creation of an "innovative, excellent, open, and harmonious" research environment. As one of the key social sciences research centres at Xi’an Jiaotong University (XJTU), the SRIICL serves as the major platform for XJTU Outstanding International Legal Personnel Education Centre, one of the 22 national centres of this kind in China, and XJTU Collaborative Innovation Centre for Silk Road Economic Belt Studies (CIC-SREBS). 

 

Professor Wenhua SHAN, Dean of XJTU School of Law, a 1000Plan Chair Professor and MOE “Changjiang Scholar” Chair Professor, acts as the Director of the SRIICL. Prof. James Crawford, a MOE “Changjiang Scholar” Chair Professor at XJTU and Member of the International Court of Justice (ICJ), holds the Honorary Directorship. The SRIICL has 6 full professors, 3 associate professors and 10 lecturers, including 1 1000Plan Chair Professor, 2 MoE “Changjiang Scholar” Chair Professors, 2 awardees of MoE “New Century Excellent Talents”, 1 awardee of Shaanxi Provincial “Hundred Young Talents”, 3 XJTU Tengfei Distinguished Professors and numerous foreign teachers. Key members of the SRIICL have all obtained PhD degree from renowned domestic and foreign universities and some of them had held senior academic positions overseas. In addition, the SRIICL has appointed several world leading scholars as Marco PoloFellows, such as Professor Jürgen Basedow, Secretary General of International Academy of Comparative Law (IACL) and Director of Max Planck Institute for Comparative and International Private Law, and Meg Kinnear, Secretary General of International Center for Settlement of Investment Disputes (ICSID), and several outstanding Chinese scholars as Zheng HeFellows, such as H.E. Jielong Duan and H.E. Huikang HUANG, both former Director-General of the Department of Treaty and Law of the Ministry of Foreign Affairs, and H.E. Yuejiao ZHANG, Member of the Appellate Body of the World Trade Organization (WTO).

 

Through several years’ efforts, the SRIICL has gradually established international influence in some fields, such as International Investment Law, International Trade Law, International Commercial Law, Resources, Energy and Environmental Law and Space Law. SRIICL researchers have published 6 English monographs and edited collections with international publishers such as Oxford University Press, Cambridge University Press, BRILL/Martinus Nijhoff, Hart Publishing, and Routledge, and dozens of research articles on international leading journals such as American Journal of Comparative Law, European Journal of International Law, ICSID Review, Journal of World Trade, Cambridge Law Journal,The Modern Law Review, and Cornell Journal of International Law. Moreover, they have chaired over 50 significant international and domestic research projects supported by the IACL, the OUP, the EU, the UK Jurist Association, the National Social Science Fund, the Ministry of Education, the Ministry of Commerce, and the Ministry of Justice. In particular, the SRIICL leads the country in the area of Silk Road Economic Belt (SREB) studies, with one national grand research project, one national key research project and a few Shaanxi provincial key research projects. On 22 January 2015, the MOFCOM-Shaanxi-XJTU Collaborative Innovation Centre for Silk Road Economic Belt Studies (CIC-SREBS) led by the SRIICL was officially launched, with support from SDRC and MFA, among others.

Based in Xi'an, the eastern starting point of the ancient Silk Road, the CIC-SREBS aims to become the premier international think tank on the Silk Road Economic Belt (SREB) that promotes collaborative and innovative research on the legal, political, social and cultural aspects of the SREB construction and relevant talent cultivation and academic exchanges. It intends to integrate best research and educational resources of China, the SREB region and other countries to provide the highest quality academic and educational support for the construction of an SREB that serves the best interests of the peoples within and beyond the SREB. 

 

The CIC-SREBS is an initiative under the “2011 Collaborative Innovation Project” (the “2011 Project”), China's most recent campaign to build world-class research platforms that are capable of solving key urgent issues faced by the country, by integrating national and international resources of policy-making, academic, research, and industrial sectors. The Centre is co-sponsored by the Ministry of Commerce (MOFCOM), the Shaanxi Provincial Government and Xi'an Jiaotong University (XJTU) and has received strong backing by other authorities including MFA, SDRC and CASS. It intends to soon apply for a “National Collaborative Innovation Centre”.

China International Investment Arbitration Forum

The China International Investment Arbitration Forum (CIIAF) was established in Xi'an in February 2019. It is China's first cooperation platform for international investment law theory and practice research, and the first professional forum for international investment arbitration studies. CIIAF was jointly sponsored by the China International Economic and Trade Arbitration Commission and the School of Law of Xi'an Jiaotong University. The founding members also included School of Law of Xiamen University, School of Law of Wuhan University, School of Law of Fudan University, School of Law of University of International Business and Economics Law School, School of Law of Renmin University of China, and School of International Law of China University of Political Science and Law, as well as Zhong Lun Law Firm, Beijing Huanzhong & Partners, Global Law Office, and Chen & Co. Law Firm. CIIAF is honored to be supported by the Department of Treaty and Law of the Ministry of Commerce, and is fortunate to invite experienced experts from areas of international investment law and arbitration to form an advisory committee. The forum secretariat is located at the School of Law of Xi'an Jiaotong University.

 

As a non-profit cooperation platform, CIIAF is based in China and faces the world. Its object is to sends out Chinese professionals’ voice for the perfection of international investment law and arbitration. The forum is an open platform, and any other institutions and individuals interested in CIIAF are welcome to apply for membership. CIIAF is featured by its various reports and critical analysis on international investment law, which will be published through its website and annual conference.
